Welcome to Noje-Ceylon, operated by Noje-Ceylon Travel Services (hereinafter referred to as “Noje-Ceylon,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, including any content, functionality, and services offered on or through the website (collectively, the “Services”). By accessing or using the Services, submitting a booking inquiry, or making a reservation, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Services.

These Terms apply to all users, including individuals booking tours for personal use and any third parties acting on behalf of a group. We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Services after changes constitutes acceptance of the revised Terms.

1. Booking and Reservations

1.1 Making a Booking

  • All bookings must be made through our website, by phone (+94 76 940 9400), or via email (info@noje-ceylon.travel). A booking is confirmed only upon receipt of a written confirmation from us and full or deposit payment as specified.
  • You must provide accurate and complete information during the booking process, including passenger details, contact information, and any special requirements (e.g., dietary needs, accessibility accommodations).
  • All tours are subject to availability. We reserve the right to refuse or cancel any booking at our discretion.

1.2 Payment 

  • Payments can be made via credit/debit card, bank transfer, or other methods specified at checkout. All prices are quoted in USD or LKR (Sri Lankan Rupees) and are exclusive of any applicable taxes, fees, or surcharges unless stated otherwise.>
  • A deposit (typically 30-50% of the total cost) is required to secure a booking, with the balance due 30 days prior to the tour start date. Late payments may result in cancellation.
  • All payments are processed securely. You authorize us to charge your payment method for the full amount upon confirmation

 1.3 Tour Descriptions

  • Tour itineraries, prices, and details are provided in good faith based on information available at the time of publication. We reserve the right to make minor changes to itineraries for operational reasons, such as weather, road conditions, or unforeseen circumstances, without liability.

2. Cancellations and Refunds

2.1 By You (Customer Cancellation)

  • Cancellations must be notified in writing via email to info@noje-ceylon.travel.
  • Cancellation fees apply as follows (as a percentage of the total tour cost):
    • More than 60 days before departure: 20% retention fee.
    • 30-60 days before departure: 50% retention fee.
    • Less than 30 days before departure: 100% retention fee (non-refundable).
  • No refunds will be given for unused portions of a tour due to early departure, voluntary changes, or no-shows.
  • In the event of a group booking, cancellations by individual participants may affect the overall group rate; please contact us for details.

2.2 By Us (Noje-Ceylon Cancellation)

  • We reserve the right to cancel or alter a tour due to insufficient participants, force majeure events (see Section 6), or other circumstances beyond our control. In such cases, we will offer a full refund or an alternative tour of equal or greater value.
  • If we cancel within 30 days of departure, we will reimburse any non-recoverable expenses you incur (e.g., non-refundable flights), subject to providing receipts.

3. Tour Operations and Participant Responsibilities

3.1 Conduct During Tours

    • Participants must comply with all instructions from our guides and drivers. Disruptive behavior, intoxication, or failure to follow safety protocols may result in removal from the tour without refund.

We promote responsible tourism: Respect local customs, wildlife, and the environment. Littering, unauthorized photography in restricted areas, or interference with wildlife is prohibited.

3.2 Health and Fitness

  • Tours involve physical activities such as walking, hiking, or climbing (e.g., at sites like Sigiriya). Participants must be in good health and disclose any medical conditions, allergies, or disabilities at booking.
  • We recommend travel insurance covering medical emergencies, trip cancellation, and evacuation. We are not responsible for any health-related issues arising during the tour.
  • By booking, you confirm that all participants are fit to travel and have appropriate vaccinations (e.g., for Sri Lanka: Hepatitis A, Typhoid; check current requirements).

3.3 Children and Minors

  • Children under 12 must be accompanied by a parent or guardian. We offer child discounts; please inquire. Infants (under 2) may travel free but require their own seat for safety.

4. Liability and Disclaimers

4.1 Our Liability

  • We truly value your trust and safety, and we do our best to create memorable experiences. That said, to the fullest extent allowed by law, we—along with our team, partners, and affiliates—cannot take responsibility for any loss, damage, injury, delay, or inconvenience stemming from unexpected events like natural disasters, weather changes, strikes, health quarantines, government rules, conflicts, or anything else outside our reasonable control.
  • We’re committed to providing safe and enjoyable tours, so we’re not responsible for personal injuries, property issues, or losses unless they’re directly due to our own negligence, which we’d address promptly. In those rare cases, our support would be limited to the amount you paid for the tour.
  • We take great care in maintaining our vehicles and equipment to the highest standards, though we understand that, as with any adventure, we can’t offer absolute guarantees against the occasional unexpected hiccup.

4.2 Your Liability

  • You agree to indemnify us against any claims arising from your negligence, breach of these Terms, or willful misconduct.

4.3 Third-Party Services

  • Please note that Noje-Ceylon does not provide hotel bookings or airline ticketing services. Any such arrangements are your responsibility and should be made directly with the relevant providers.
  • Our tours may involve optional engagements with third parties, such as local operators or guides, who offer exceptional local knowledge and insights to enrich your journey. These are entirely at your discretion—you’re free to decide whether to participate, and if so, you’ll handle any direct payments to them. While we thoughtfully select these partners for their expertise, we act only as a facilitator and cannot be held responsible for their performance or any related issues. We suggest reviewing their individual terms if you choose to engage.

5. Privacy and Data Protection
Your privacy is important to us. We collect and use personal data in accordance with our Privacy Policy (available here or upon request). By using the Services, you consent to such processing for booking, communication, and marketing purposes (you can opt out anytime).

6. Force Majeure
We shall not be liable for failure to perform any obligations under these Terms if caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics (e.g., COVID-19 restrictions), civil unrest, or transportation strikes. In such cases, we will work to mitigate impacts and offer alternatives where possible.

7. Governing Law and Dispute Resolution
These Terms are governed by the laws of Sri Lanka. Any disputes shall be resolved exclusively in the courts of Colombo, Sri Lanka. We encourage amicable resolution first—contact us at info@noje-ceylon.travel.
